This petition has been filed seeking to condone the delay of 873 days in filing the appeal.

2. Heard the learned counsel for the petitioner.

3. Despite the receipt of notice, respondents no.1 to 3 neither appeared nor represented through their counsel.

4. The sole petitioner would aver that due to his poor financial condition, he went to neighbouring state for agricultural work. Hence, the delay of 873 days occurred, which is not wanton.

5. The reasons mentioned in the affidavit appear to be reasonable and acceptable. Hence, this Court is inclined to allow this Civil Miscellaneous Petition and the delay of 873 days is condoned on condition to waive the interest for the delay period. 12.09.2025 Mac https://www.mhc.tn.gov.in/judis
