O R D E R
Seeking directions to the 1st respondent to consider the representation of the petitioner dated 27.04.2024, and to allot the alternative plot in lieu of Plot No.2/67, Block No.B, to extent of 880 sq.ft, situated in Survey No.297 (Part) Kattankulathur Village, Chengalpattu District, the above writ petition is filed.
2. Mr.R.Thamarai Selvam, learned Standing Counsel takes notice for R1, Mr.V.Manoharan, learned Additional Government Pleader takes notice for R2.
3. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.
4. The petitioner was allotted the vacant LIG-II Plot No.2/67 to an extent of 880 Sq.ft, in Block B in Survey No.297 (Part) Kattankulathur Page No.2 of 6
Village, Maraimalai Nagar on 23.08.2005, under Hire Purchase Scheme. Pursuant to the allotment, the entire sale consideration was paid by the petitioner. However, there were encroachments in the land allotted to the petitioner and the same was brought to the knowledge of the 1st respondent.

The 1st respondent advised the petitioner to have the sale deed registered and undertook to remove the encroachers from the property and handover vacant possession to the petitioner before the registration of the sale deed. The petitioner, on the basis of the advise of the first respondent, registered the sale deed in his favour on 26.09.2013, vide document No.10223/2013, on the file of the Joint Sub-Registrar No.2, Chengelpattu. As per the conditions of sale deed, the 1st respondent was bound to hand over vacant possession, free from all the encumbrances and was further forced to indemnify the petitioner. According to the petitioner, in terms of the conditions of sale, the 1st respondent was bound to allot an alternative plot to the petitioner. Under the circumstances, the petitioner submitted a representation on 27.04.2024, for removal of encroachments, but no action Page No.3 of 6
was taken. Aggrieved by the inaction of respondents, the petitioner filed the above writ petition.

Though the writ petition was filed raising several issues, the learned counsel for the petitioner submitted that it would suffice if, this Court directs the first respondent, to consider the petitioner's representation dated 27.04.2024, for allotment of alternative plot in lieu of Plot No.2/67, Block No.B, to extent of 880 sq.ft, situated in Survey No.297 (Part) Kattankulathur Village, Chengalpattu District.

In view of the above facts and considering the limited relief sought for by the learned counsel for the petitioner, without going into the merits of the case, I am inclined to direct the first respondent, to consider the petitioner's representation dated 27.04.2024, and pass appropriate orders on merits and in accordance with law, within a period of eight(8) weeks from the date of receipt of a copy of this order.

8. With the aforesaid direction, this writ petition is disposed of. No costs.
