Prayer: Writ Petition filed under Section 226 of Constitution of India praying for issuance of Writ of Mandamus to direct the 3rd respondent to conduct survey measurement to fix boundaries to petitioners land in S.No.55/2 to an extent of 0.5 cents in Puthananthal Village, Vellimedupettai Panchayat, Tindivanam Taluk and consequently grant individual Patta in Petitioners name based on the application made by petitioners on 10.07.2019 in pursuance of the directions issued by the 1st and 2nd respondents herein in O.Mu.AA2/19233/2020, dated 16.09.2020 and O.Mu.A3/5542/2020, dated 19.09.2020 respectively . O R D E R

This Writ Petition has been filed for the issue of Writ of Mandamus directing the 3rd respondent to consider the application submitted by the petitioner on 10.07.2019 and conduct the survey of the subject property and grant individual patta in the in the name of the petitioner.

2. Mr. S.N.Parthasarathy, learned Govt. Advocate appearing on behalf of the respondents 1 to 3 submitted that the 3rd respondent has called the parties for an enquiry on 5.1.2021 at 3 p.m. The learned counsel for the petitioner submitted that the petitioner can be present at the time of enquiry along with all the relevant documents.

3. Taking into consideration the facts and circumstances of the case and also of the fact that the 3rd respondent has already called the parties for an enquiry, there shall be a direction to the 3rd respondent to conduct the enquiry after affording an opportunity to the petitioner and one Mrs.Vijayakumari and final orders shall be passed strictly in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

4. This Writ Petition is disposed of with the above directions. No costs.
