Abdul Razaak v. Adam Sahib

CMP.Nos.14873, 14874 & 14875 of 2021 in S.A.Nos.171, 172 & 173 of 2010 C.V.KARTHIKEYAN, J.

All these three Petitions have been filed consequent to the death of the sole appellant Abdul Razaak to bring on record his legal heirs as the appellants 2 to 7 in the above Second Appeals.

2. In a common affidavit filed in support of these three Petitions, it had been stated that the sole appellant Abdul Razaak had died on 10.06.2015, leaving behind the petitioners as his legal heirs. It must also be pointed out that the Second Appeals have not yet been admitted. But at any rate, to afford an opportunity to the petitioners herein to give necessary instructions for the learned counsel to argue on the admission of the Appeals, I would allow these Petitions.

3. Accordingly, these Civil Miscellaneous Petitions are allowed. The Registry to carryout the necessary amendment reflecting the death of the sole appellant and bring on records the legal heirs who are the petitioners in these three Civil Miscellaneous Petitions.
