PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 8 to consider the petitioner's representation dated 29.04.2025 and remove the dilapidated structure left by the 9th respondent in Survey No.72/2A1C and pass orders.

Mr. M. Shajakhan, Special Government Pleader takes notice for R1 to R5. Mr.J. Subbiah, Government Advocate takes notice for R7.

2. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. This petition is filed seeking for a Writ of Mandamus directing the respondents 1 to 8 to consider the petitioner's representation dated 29.04.2025 and remove the dilapidated structure left by the 9th respondent in Survey No.72/2A1C.

4. The petitioner is the absolute owner of the land and house in Old Survey No.74/2(Part), New Survey No.316/13 and Old Survey No.72/2A ( Part) and New Survey No.72/2A1B. The petitioner and his family members were residing in the said house without any obstruction from the third parties. The 9th respondent is in possession of the adjacent land situated in Survey No.72/2A1C in southern side of the petitioner's property, which is in a dilapidated condition. According to the petitioner as the dilapidated structure posed threat to his property and life, on 29.04.2025 he submitted a representation to the respondents 1 to 8 complaining of the same. As no action was taken on the representation, the petitioner was constrained to file the above writ petition for the above said relief.

5. The learned counsel for the petitioner submitted that though he submitted a representation to the respondents 1 to 8, for removal of the dilapidated structure, no action was taken till date. The learned counsel therefore, sought for immediate action for the removal of the dilapidated structure.

6. The facts of the case are not disputed, the petitioner submitted his representation on 29.05.2025 for removal of the dilapidated structure left by the 9th respondent in his premises. As the 9th respondent's structure poses a threat to the petitioner's property and life, I am inclined to direct the first respondent to consider the petitioner's representation dated 29.05.2025 and to pass orders on merits and in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order.

7. Accordingly, this writ petition is disposed of. However, there shall be no order as to costs.
