: Respondent Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Declaration declaring that Paragraph 7 II(i) of the EIA notification dated 14 September 2006 is, to the extent of noninclusion of climate change in the said paragraph, violative of Articles 14 and 21 of the Constitution of India, and directing the respondentUnion of India to include the expression "climate change" as one of the vital environmental concerns in paragraph 7II(i) of the EIA notification dated 14 September 2006.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The petitioner seeks a direction to the respondent to include the expression "climate change" in the Environmental Impact Assessment (EIA) notification dated 14.09.2006 relating to environmental clearance process for new projects.

2. It is the case of the petitioner that climate change aspect was considered by the Hon'ble Supreme Court in the case of M.K.Ranjitsinh and others vs Ors [W.P 2019] where the issue of climate change, as a serious threat, was noticed. Therefore, in the environmental clearance proceedings under the notification, proper amendment is necessary.

3. We are of the view that what is being raised by the petitioner before this Court is a matter to be considered by the experts as to the manner in which environmental clearances have to be granted, and

not by this Court.

4. The petitioner may approach the respondent and submit a representation in this regard.
