This Civil Miscellaneous Petition has been filed to condone the delay of 306 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the second respondent has got objections in allowing the petition.

4. The petitioner would aver that due to the injuries suffered on account of the accident, he lost his earning power and because of financial constraints, he was not in a position to arrange funds for filing the Civil Miscellaneous Appeal. Hence, delay of 306 days occurred in filing the Civil Miscellaneous Appeal.
