PRAYER: Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing respondents 1 and 2 to provide adequate police protection to the petitioner, his men, agents and properties situated in Survey No.49, Suleswaranpatti Village, Pollachi Taluk, Coimbatore District, by considering the petitioner's complaint dated 29.12.2025 and CSR Receipt No.668 of 2025 dated 29.12.2025 issued by the second respondent police and consequently restrain respondents 3 to 10 from interfering with the petitioner's peaceful possession and enjoyment except under due process of law.

O R D E R
This Writ Petition (Criminal) has been filed seeking direction to respondents 1 and 2 to provide police protection to the petitioner by considering his complaint dated 29.12.2025 and to restrain respondents 3 to 10 from interfering with the petitioner's peaceful possession and enjoyment Mr.A.Damodaran, learned Government Advocate (Criminal Side), takes notice on behalf of respondents 1 & 2. 2/5
In view of the consent expressed by the learned counsel on either side, this Writ Petition (Criminal) is taken up for final disposal at the admission stage itself. Notice to respondents 3 to 10 is dispensed with inasmuch as no order prejudicial to their interest is passed. Mr.A.Damodaran, learned Additional Public Prosecutor, on instructions submits that based on the complaint given by the petitioner, an enquiry was conducted by the second respondent in C.S.R.No.668 of 2025 and complaint was closed, as the dispute between the parties was found to be civil in nature. He further submits that the suit filed by the petitioner before the Additional District Munsif Court, Pollachi, in O.S.No.189 of 2013 was dismissed on 08.10.2025, against which Appeal Suit No.2 of 2026 is pending before the Sub-Court, Pollachi.
At this juncture, the learned counsel for the petitioner seeks liberty to approach before the competent appellate Court. 6.
In view of the above, leave is granted to the petitioner to move appropriate application before the Sub-Court, Pollachi. If any such 3/5
application is filed by the petitioner, the learned Judge shall take the application on file and pass appropriate orders as per law, after hearing both sides.

With the above directions, this Writ Petition (Criminal) is disposed of. No costs.
