This Civil Miscellaneous Petition has been filed to condone the delay of 380 days in filing the above appeal.

2. Heard the learned counsel for the petitioner and the learned counsel for the third respondent/Insurance Company.

3. The learned counsel for the third respondent has no serious objection in allowing this petition.

4. The petitioner would aver that he suffered disability to the extent of 28% on account of accident. Due to this, he is not in a position to do his work as before, and owing to his financial situation, he could not arrange the necessary funds for filing this appeal.

5. The reasons assigned by the petitioner in the affidavit appear to be reasonable and acceptable. Therefore, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 380 days shall stand waived.
