Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus to direct the respondents herein to transfer the name of the WF HT SC No. 039224340960 granted for the premises in Survey No.23/1C2 measuring to an extent of 1 acre along with the wind energy generator present in S.No. 23/1C1, situate at Thungavi Village, Madathuklam Taluk, Tirupur, from the name of KCP Packagings Limited to the name of the petitioner company based on petitioner application for name transfer dated 06.05.2026 within stipulated time frame. Heard the learned Senior Counsel for the petitioner and the learned Standing Counsel for respondents 1 to 3. 2\6

The petitioner purchased the petition mentioned property under a SARFAESI auction sale. The property originally belonged to the 4th respondent. However, it appears that the 4th respondent/erstwhile owner had left behind electricity dues to the tune of Rs. 1,21,05,729/-. The respondent Corporation wanted the petitioner to clear the said outstanding consumption charges. Contending that the liability of the erstwhile owner will not pass on to the petitioner, who is an auction purchaser, the petitioner filed W.P. No. 8515 of 2026 and this Court, vide order dated 05.03.2026 granted interim direction to the official respondents therein not to disconnect the electricity service connection till the next date of hearing on condition that the petitioner deposits a sum of Rs.30,00,000/-. The petitioner is ready to comply with the said condition.

But, the petitioner is unable to do so as the service connection is yet to be changed in the name of the petitioner. By changing the service connection in the name of the petitioner, the respondent Corporation will not be put to any kind of prejudice. The liability of the petitioner to clear the consumption charges left uncleared by the 4th respondent will be decided in W.P. No. 8515 of 2026.

In such view of the matter, I direct the Chief Engineer, NCES, TNGECL, Chennai to transfer the service connection WF HT SC No. 039224340960 in the name of the petitioner immediately and without any delay so as to enable the petitioner to pay the sum of Rs.30,00,000/- as directed by this Court vide order dated 05.03.2026 in W.M.P. No. 9218 of 2026 in W.P. No. 8515 of 2026.

With the above direction, the writ petition is allowed. No costs.
