..Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct respondents to consider the petitioner's representation dated 08.09.2021 for permitting the students namely 1.Charumathi.M. 2.Girija.C 3.Narmadha.M 4.Prithika.D 5.Paranthaman.D and 6.Jancy.J to write examination in Diploma in Teachers Training Education.

ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the respondents to consider the representation made by the petitioner institution, wherein, the institution is seeking for permission to allow six students to write the examination in Diploma in Elementary Education.

2.When the matter was taken up for admission, the learned Government Advocate appearing on behalf of the respondents https://hcservices.ecourts.gov.in/hcservices/

submitted that the last examination is going to be held tomorrow, ie., on 22.09.2021 and that the request made by the petitioner cannot be considered at this juncture. The learned counsel further submitted that the petitioner Institution ought not to have permitted those students to undergo the course, even without getting an approval from the respondents. 3.This Court is able to find a lot of force in the submissions made by the learned Government counsel.

4. The petitioner institution ought not to have permitted these students to undergo the course even without an approval. The learned counsel for the petitioner submitted that these students were not able to submit all the relevant documents on time due to the pandemic situation. This excuse given by the petitioner cannot be taken into consideration, since admittedly the respondents have not granted approval for these students to undergo the course. Therefore, the petitioner Institution, having allowed the students to undergo the course ultimately seeking for permission to write the examination, is totally unsustainable. The Hon'ble Supreme Court has time and again held that the Courts should not permit such students to write the examination on misplaced sympathy.

5. In view of the above, the relief as sought for by the petitioner cannot be granted and in the result, this writ petition is dismissed. No costs. Consequently connected Miscellaneous Petition is closed.
