Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to issue the final order of intimation to the petitioner, on appointment to the allotted post of Senior Inspector in Co-operative Societies Department included in combined Civil Services Examination - II (Non-Interview Posts) (Group-IIA Services) as per the Endorsement dated 15.05.2024 in C.No.271/PSD-A2/2022, on the file of the second respondent subject to the outcome of CMP No.20636 of 2024 in W.A.(SR) No.20626 of 2024. ORDER
This Writ Petition has been filed for a direction directing the respondents to issue the final order of intimation to the petitioner, on appointment to the allotted post of Senior Inspector in Co-operative Societies Department included in combined Civil Services Examination - II (Non-Interview Posts) (Group-IIA Services) as per the Endorsement dated 15.05.2024 in C.No.271/PSD-A2/2022, on the file of the second respondent subject to the outcome of CMP No.20636 of 2024 in W.A.(SR) No.20626 of 2024.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. In view of the earlier order passed by this Court in W.P.No.2999 of 2024 dated 12.02.2024, the petitioner was provisionally selected to the post of Senior Inspector in Co-operative Societies Department. However, the petitioner was not issued any appointment 2/4
order so far, on the ground that as against the order passed by this Court in W.P.No.2999 of 2024 dated 12.02.2024. The respondents have preferred a writ appeal along with a petition in CMP No.20636 of 2024 to condone the delay in filing the writ appeal in W.A.(SR) No.20626 of 2024, which is pending. So far no interim order has been obtained by the respondents in the writ appeal.
4. In view of the above, the respondents are directed to issue order of appointment to the petitioner to the post of Senior Inspector in Co-operative Societies Department forthwith. It is also made clear that the appointment of the petitioner is subject to the result of the writ appeal.
