ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 305(e) and 326(a) of BNS 2023 in Crime No.88 of 2026, seeks anticipatory bail.

The case of the prosecution is that on 05.03.2026, while the respondent police were conducting routine patrol within the jurisdiction of Kandili Police Station, they noticed that a JCB vehicle bearing Regn.No.TN-83-MA-3304 allegedly involved in illegal and transportation without valid permit. Hence, the present case was registered.

The learned counsel for the petitioners submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He further submits that the petitioner is are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the Petitioner.

4. The learned Government Advocate (Crl.Side) reiterated the prosecution case and submitted that the petitioner has got three previous cases . Hence, opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

Taking into consideration that the learned Government Advocate (Crl.Side) has strongly opposed to grant anticipatory bail to the petitioner on the ground that the Petitioner has got three previous cases of similar nature which clearly demonstrate that the Petitioner has misused the liberty and subverted justice. Hence, this Court is of the firm view that the petitioner does not deserve anticipatory bail. Hence, this Criminal Original Petition is dismissed.
