This Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus calling for the records relating to the show cause notice Na.Ka.No.1587/2020/U.E(U)/A2 dated 23.10.2020 passed by the 1st respondent, quash the same and consequently direct the 1st respondent to drop the proposal of taking of action against the petitioner for the alleged charges framed against the petitioner. ORDER
This Writ Petition has been filed challenging the Show Cause Notice issued by the 1st respondent dated 23.10.2020 and for a
consequential direction to the 1st respondent to drop the proposal of taking action against the petitioner based on the charges framed against the petitioner in the show cause notice.
2. Heard M/s.J.Hemamalini, learned counsel for the petitioner and Mr.E.Balamurugan, learned Special Government Pleader appearing on behalf of the respondents.
3. In the considered view of this Court, the impugned show cause notice issued by the 1st respondent gives the details of various charges that have been made against the petitioner and the petitioner has also submitted a reply to the show cause notice on 10.11.2020. After having given the reply, the petitioner has chosen to approach this Court only on the apprehension that the respondents have initiated the proceedings with a predetermined mind.
4. This Court cannot act on mere apprehensions and this Court expects the respondents to act on the explanation given by the petitioner strictly in accordance with law. This Court is not inclined to interfere with the impugned show cause notice issued by the 1st respondent.
