The learned Counsel appearing for the Appellant had filed this petition seeking extension of time for payment of the balance of fine amount. As per the judgment of the learned Additional Sessions Judge, Krishnagiri in S.C.No.16 of 2018, the Accused was convicted for the offence under Section 304(ii) IPC by imposing sentence of 10 years Rigorous Imprisonment and fine of amount Rs.50,000/-. In the appeal in Crl.A.769 of 2019 by judgment dated 28.07.2022, the offence under Section 304(ii) IPC was converted as offence under Section 326 of IPC based on the evidence available before the learned Additional Sessions Judge, Krishnagiri.

Therefore, the sentence of imprisonment imposed under Section 304 (ii) IPC was modified as sentence of imprisonment under Section 326 of IPC and sentenced to undergo Rigorous Imprisonment for three years and fine of Rs.2,05,000/-. Already as per the judgment in S.C.No.16 of 2018, Rs.50,000/- was imposed as fine. That was deposited before filing the Crl.A.No.769 of 2019.

the date of receipt of a copy of the judgment dated 28.07.2022 and ordered to pay the balance fine amount of Rs.1,55,000/- within a period of eight weeks from the date of receipt of the copy of the judgment in Criminal Appeal No.769 of 2019.
