Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order bearing 423/MU.U/2025 dated 21.04.2026 passed by the 1st respondent and quash the same and consequently, direct the respondents to grant ordinary leave for 21 days without escort to the detenu, 1/5

O R D E R

(Order of the Court was made by G.R.SWAMINATHAN, J.

) Heard both sides.

2. The petitioner's son namely, Sabarinathan, [Convict No.9752 and PID No.474702], Son of Raman, is undergoing 10 years Rigorous Imprisonment. He is presently housed in the second respondent Prison. The convict prisoner sought to come out on 21 days ordinary leave. The request was granted vide order dated 21.04.2026. However, it was stipulated that the prisoner will be accompanied by a police escort. Aggrieved by the said condition, this writ petition has been filed owing to the financial implications. 2/5

3. Considering the overall circumstances, we are of the view that the said condition can be deleted and the presence of the convict prisoner can be secured by directing him to appear before the Pappireddy police station, Dharmapuri District, daily at 7.00 p.m.

4. We direct the respondents to grant twenty one (21) days ordinary leave for the convict without escort.

5. The writ petition is allowed on the following conditions:~ (a) The convict-prisoner, Sabarinathan, Son of Raman, aged about 27 years, convict prisoner, bearing Convict No.9752 and PID No.474702, confined at Central Prison, Salem, is granted ordinary leave for twenty one (21) days from 27.05.2026 to 16.06.2026 without escort. (b) The convict prisoner shall be released from the prison at 05.00 p.m., on 26.05.2026 and he shall return to the prison at 10.00 a.m., on 17.06.2026. (c) During the said leave period, he shall report before the Inspector of Police, Pappireddy Police Station, Dharmapuri District, daily at 07.00 p.m., 3/5

from 27.05.2026 onwards, without fail.

(d) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
