Crl.O.P.No.14700 of 2023 G.CHANDRASEKHARAN.J., The petitioner, who was arrested and remanded to judicial custody on 09.02.2022 for the offences punishable under Sections 174 of Cr.P.C., subsequently altered into Sections 302 & 201 of IPC in Crime No.66 of 2022 on the file of the respondent police, seeks bail.

The learned counsel for the petitioner submitted that, petitioner is a 3rd accused in Crime No.66 of 2022 registered for the offences under Section 174 of Cr.P.C., subsequently altered into Sections 302 & 201 of IPC. Petitioner is in Judicial Custody from 09.02.2022. The allegations as against the petitioner is that, petitioner had helped the other accused in transporting and concealing the body of the deceased. Petitioner was not involved in the commission of the murder of the deceased. Thus, he prayed for grant of bail.
3. In reply, the learned Government Advocate (Crl. Side) opposes the petition on the ground that, accused and the defacto complainant were involved in selling of ganja. They had quarrel in 1/3
dividing the gain in ganja selling. In that quarrel, A1 had murdered the deceased, in which, petitioner had helped in transporting and concealing the body of the deceased. He further submitted that, investigation in this case is not yet completed.
4. Considering the nature and graviy of the offence said to have committed by the petitioner and also the fact that, investigation is not yet completed, this Court is not inclined to grant bail to the petitioner at this moment.
5. Accordingly, this Criminal Original Petition is dismissed. 03.07.2023 Sma 2/3
