Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the respondents to sanction the rest of mortgage loan of Rs.2.3 lakhs based on the mortgage deed executed by the petitioner in favour of the first respondent vide document number 1943 of 2020 dated 05.08.2020.

ORDER

This Writ Petition has been filed for a direction, directing the respondents to sanction the rest of mortgage loan of Rs.2.3 lakhs based on the mortgage deed executed by the petitioner in favour of the first respondent vide document number 1943 of 2020 dated 05.08.2020.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. Without expressing any opinion on the merits of the writ petition, the petitioner is at liberty to file a fresh loan based on the very same mortgage of his properties. On receipt of such application from the petitioner, the first respondent is directed to consider the same and disburse the loan, if the petitioner is eligible for any further loan on the very same mortgage.

4. With the above direction, this writ petition stands disposed of. No costs.
