ORDER
The petitioner, who was arrested and remanded to judicial custody on 18.03.2026 for the alleged offence under Section 296(b), 126(2), 118(1) and 103 of BNS 2023 in Crime No.133 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that due to previous enmity, quarrelled with the deceased regarding an illicit relationship with A1's wife and threatened him with dire consequences. Suspecting his wife's fidelity, in furtherance thereof, he murdered the deceased. Hence, this case.
3. The learned counsel for the petitioner submitted that the petitioners are arrayed as A1 to A3. The occurrence took place on 17.03.2026. He further submitted that the petitioners have been falsely implicated in this case and they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are in custody since 18.03.2026 and they are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioners.
4. The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution's case and, upon instructions, submitted that the investigation is at preliminary stage. Hence, he opposed to grant bail to the petitioners.
5. I have considered the submissions made on both sides and also perused the records available.
6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); this Court is of the firm view that it is not appropriate to enlarge the petitioners on bail at this stage.
