Defendant Plaint filed under Order IV Rule 1 of Original Side Rules read with Order VII Rule 1 and 2 CPC for judgment and decree against the defendant for partition of 1320 sq.ft of undivided share of land as described in Schedule 'B' hereunder in the total extent of land of 3960 sq.ft as described and comprised in Schedule 'A' hereunder, by metes and bounds by locating and identifying the same separately on ground with appropriate measurements as feasible and commonly known to be suitable for putting up a building/super structure by sanction of plan to be obtained from statutory authorities, to deliver possession of the property as envisaged under clause (a) above as may be decreed by this Court in terms of prayer (a) above and to pay cost of the suit.

JUDGMENT

Mr.Roshan Balasubramanian, learned counsel on record for plaintiff submits that he has instructions from the plaintiff to withdraw this suit.

2. Learned counsel submits that the matter has been settled out of Court. Learned counsel has also made an endorsement in the Court file to this effect, which reads as follows:

' As per instructions the suit may be permitted to be withdrawn without costs.
