PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, to call for the records of the respondent dated 24.06.2023 and quash the same and consequently directing the respondent to grant permission and police protection to conduct cultural programme (Adal Padal Nigalchi) in the event of Mannaickenpatti Village Arulmigu Sree Sakthi Mariyamman Temple Festival at Valapadi Taluk, Salem District on 28.06.2023 between 06.00 PM and 11.00 PM. ORDER

This Writ Petition has been filed calling for the records of the respondent dated 24.06.2023 and quash the same and consequently directing the respondent to grant permission and police protection to conduct cultural programme (Adal Padal Nigalchi) in the event of Mannaickenpatti Village Arulmigu Sree Sakthi Mariyamman Temple Festival at Valapadi Taluk, Salem District on 28.06.2023 between 06.00 PM and 11.00 PM.

The learned counsel for the petitioner submitted that the petitioner submitted a representation to the Inspector of Police, Valapadi Police Station, seeking permission for organizing Adal Padal event of Mannaickenpatti Village Arulmigu Sree Sakthi Mariyamman Temple Festival at Valapadi Taluk, Salem District, on 28.06.2023. The said representation was rejected. Challenging the said order, this petition is filed.

3. The learned Government Advocate(Crl.side) submitted that the permission was rejected for the reason that there is a Cricket match scheduled on the same day at Kaatuveppilaipatti.

4. Considered the rival submissions and perused the records.

5. This Court finds from the reason for rejection of permission for conducting Adal Padal program due to Cricket match to be played at Kaatuveppilaipatti is not proper and appropriate reason. The Cricket match is going to be played during day time and Adal Padal program is going to be performed at night. Therefore, there is no connection between both the programs. Therefore, the rejection order passed by the respondent cannot be sustained and the order dated 24.06.2023 passed by the respondent is hereby set aside.

The respondent Police is directed to consider the petitioner's representation and pass appropriate orders immediately by following the two circulars issued by the Director General of Police, Tamil Nadu, Chennai, in Rc.007301/Genl.I(1)/2019, dated 09.04.2019 and in Rc.03316/General.I(1)/2023, dated 01.06.2023 setting out the conditions to be followed before permission is given for the Adal Padal program.
