ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a Writ of Mandamus to direct the respondents to conduct survey and fix boundaries of the petitioner property comprised in S.No.383/3 (sub divided as S.No.383/3A), measuring an extent of 0.27 1⁄2 cents, situated at Gendikampatti Village, Pochampalli Taluk, Krishnagiri District and to lay the boundary stones on the four corners by considering the petitioner's representation dated 05.06.2023. 3.It is submitted by the learned counsel for the petitioner that petitioner purchased the above mentioned property vide Sale Deed dated 21.03.2016, registered as Document No.845/2016 before the SRO, Pochampalli for a valuable consideration from one R.Perumal and another. It is submitted that ever since, petitioner has been in continuous possession and enjoyment of the said property. 2/6

4.It is further submitted by the learned counsel for petitioner that petitioner submitted a representation on 05.06.2023 to carry out survey and to fix boundaries of the subject property and had also paid necessary fees for the same. However, the above representation has not been considered by the respondents till date. Hence, the present writ petition has been filed before this Court.

5.Learned Government Advocate for the respondents would submit that they would conduct survey and fix boundaries of the subject property within a time frame to be fixed by this Court, which was agreed to by the learned counsel for the petitioner. 6.In view thereof, the writ petition stands disposed of with a direction to the respondents to conduct survey and fix the boundaries of the subject property, after putting the petitioner, adjacent land owners and other interested parties including rival claimants, if any, on notice, within a period of 8 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent 3/6

to consider the matter on its own merits and in accordance with law. No costs.
