Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the Respondent for speedy trial in S.C.No.414 of 2014 on the file of the V Additional Sessions Judge, Chennai and disposed expeditiously on merit and pass any other orders as deem fit and proper in the circumstances of this case.

ORDER

This petition has been filed to direct the Respondent for speedy trial in S.C.No.414 of 2014 on the file of the V Additional Sessions Judge, Chennai and disposed expeditiously on merit and pass any other orders as deem fit and proper in the circumstances of this case.

2. Heard the learned Counsel for the petitioner, and the learned Additional Public Prosecutor for the State.

3. It is seen that the petitioners are facing trial in SC.No.414 of 2014 before the V Additional Sessions Judge, Chennai, and it is their grievance that the trial has not progressed since 2014.

4. The learned Additional Public Prosecutor would submit that there is no Presiding Officer in the said Court, https://hcservices.ecourts.gov.in/hcservices/

and therefore, this case is being called in the in-charge Court. Learned Additional Public Prosecutor further submitted that the case has been posted to 06/10/2016 for examination of LW-1 to LW-4.

5. Under such circumstances, this Court directs the V Additional Sessions Judge, Chennai or the Judge in-charge of the said Court to proceed with the trial by examining witnesses on 06.10.2016. The petitioners shall co-operate by cross examining the witnesses on the day, they are examined in chief as held by the Supreme Court in Vinoth Kumar -vsState of Punjab {2015 (1) MLJ (Crl) 288}
