Respondents Prayer: Petition under Article 226 of the Constitution of India praying for a writ of Mandamus directing the respondents 1 to 4 to conduct the enquiry on illegal auction sale held on 25.09.2020 and forbear the upcoming sand extraction from the Padur Village lake, Thiruporur Taluk, Chengalpattu District, by considering the petitioner's representation dated 28.09.2020. ORDER

(Made by SENTHILKUMAR RAMAMOORTHY,J) The petitioner complains about an illegal auction sale of sand extracted from Padur Village lake, Thiruporur Taluk, Chengalpet District. He submits that he made a representation to the respondents 1 to 4 on September 28, 2020, but no action has been taken thereon.

2. Learned Government Pleader submits that respondents 2 to 4 would consider and pass orders on the representation of the petitioner dated September 28, 2020, if they are provided a reasonable time, to do so.

3. Accordingly, without examining the merits or the tenability of the representation of the petitioner dated September 28, 2020, the respondents 2 to 4 are directed to consider the said representation dated September 28, 2020 and dispose of the same by a speaking order, within a period of eight weeks from the date of receipt of a copy of this order, after providing a reasonable opportunity to the persons likely to be affected thereby.

4. In the event the writ petitioner is aggrieved by the decision of the respondents 2 to 4, the writ petitioner may pursue his remedies in accordance with law, otherwise than by way of a public interest litigation and upon establishing his locus standi in that regard.

W.P.No.18011 of 2020 is disposed of. There will be no order as to costs. As a consequence, WMP Nos.2812 of 2021 and 22361 of 2020 are closed.
