This petition is filed to enlarge the petitioners on bail in the event of arrest in Crime No.202 of 2023 on the file of the respondent Police pending investigation.

2.The learned counsel for the petitioners submitted that petitioners are falsely implicated in Cr.No.202 of 2023 registered for the offences under Section 448, 294 (b), 323, 324 and 506 (2) I.P.C, 1860. Therefore, this petition seeking anticipatory bail.

3.In response, the learned Government Advocate (Criminal side) submitted that the dispute with regard to parking of lorry, the petitioners had attacked the victim with iron rod and hands. As a result, victim suffered head injury.

4.Considered the rival submissions and perused the records. 5.The discharge summary produced by the learned Government Advocate (Criminal side) shows that petitioner suffered temporoparietal 1/4

fracture with underlying fracture hematoma. This is a serious injury. Though the injured is now discharged from the hospital, after the effect of head injury, pain may last for some more time. Investigation in this case is not completed. Thus, this Court is not inclined to grant anticipatory bail to the petitioners.

6.Accordingly, this Criminal Original Petition is dismissed. 07.07.2023 ep 2/4
