ORDER

The petitioners have come up with the present writ petition for a declaration, declaring that the selection of the third respondent by the second respondent for award of the LPG distributorship under the Rajiv Gandhi Gramin LPG Vitrak Scheme in respect of the location at Thoppur T.Kanigarahalli pursuant to the advertisement released by the second respondent in the Dinakaran Daily dated 31.03.2010 and the draw held on 25.09.2010 at the Government Arts College, Salem Road, Dharmapuri as contrary to the aforesaid Scheme and illegal. 2.However, when the matter was taken up for consideration, the learned counsel for the petitioners, on instructions, submitted that it would suffice, if a direction is given to the second respondent to

dispose of the representation dated 07.10.2010 submitted by the petitioners, for which, the learned counsel for the second respondent has no serious objection.

3.Considering the facts and circumstances of the case and taking note of the submissions made by the learned counsel appearing for the respective parties, this Court directs the second respondent to consider the representation of the petitioners dated 07.10.2010, if not considered so far and pass appropriate orders, on merits and in accordance with law, after issuing due notice and affording an opportunity of personal hearing to the petitioners as well as the third respondent. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. 4.Accordingly, this writ petition is disposed of. No costs.
