O R D E R

(Delivered by M.M.SUNDRESH,J) Instant Habeas Corpus Petition has been filed to direct the respondents to produce the person or body of the petitioner's daughter/detenue namely Nandhiya, D/o. Renu aged about 16 years before this Court from the illegal custody of the third respondent and handover to the petitioner.

2. Heard Mr.D.Ramesh Kumar, learned counsel for the petitioner and Mr.R.Prathap Kumar, learned Additional Public Prosecutor for the respondents 1 and 2.

3. Today, when the matter is taken up for hearing, Mr.R.Prathap Kumar, learned Additional Public Prosecutor has submitted that victim has already been secured. As she did not want to join the petitioner, she has been entrusted to M/s.Annai Sathya Government Children Home, Katpadi, Vellore. Reliance has been made on the proceedings, dated 8/12/2020, of the Child Welfare Committee, Ranipet, Vellore District, for the purpose of taking the child back.

4. In as much as the third respondent is yet to be secured, a case has been registered under Section 366 A of IPC. We direct the respondent Police to take immediate steps to secure him. We also note that victim is aged about 17 years old. Therefore, necessary alteration will have to be made to the case registered by adding the requisite provisions.

5. With the above directions, instant Habeas Corpus Petition is closed.
