C.M.P. No.15997 of 2018 in C.M.S.A. No.SR6569 of 2018 T.RAJA,J.

The petitioner has come to this Court seeking an order to condone the delay of 45 days in preferring the appeal in C.M.A. No.3 of 2016 dated 10.07.2017 on the file of the III Additional District Court, Gobichettipalayam.

2.Learned counsel appearing for the petitioner would submit that after the impugned judgment and decree was passed by the III Additional District Court, Gobichettipalayam, due to financial crunch, the petitioner was unable to file the above C.M.S.A. Since there has been a delay of 45 days in preferring the C.M.S.A., the delay may be condoned which is neither willful nor wanton, but due to bonafide reasons.

3.As there was no serious objection from the learned counsel appearing for the respondent, the petition is allowed and the delay is condoned.
