Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to consider the petitioners for appointment to the post of P.G. Assistant (Chemistry) under BC Category through TRB Notification No.10/2019 dated 12.06.2019 on par

with similarly placed 27 candidates (out of 37 ) appointed as P.G. Assistant (Chemistry) even after revision of provisional selection list as per the orders of Hon'ble High Court in WP No.34099 of 2019 etc. cases dated 09.01.2020, with all consequential and other attendant benefits, in consideration of the representation submitted by the petitioners, within a time frame to be fixed by this Hon'ble Court.

ORDER

This Writ Petition has been filed for direction directing the respondents to consider the petitioners for appointment to the post of P.G.Assistant (Chemistry) under BC Category through TRB Notification No.10/2019 dated 12.06.2019 on par with similarly placed 27 candidates (out of 37) appointed as P.G.Assistant (Chemistry) even after revision of provisional selection list as per the orders of Hon'ble High Court in WP No.34099 of 2019 etc. cases dated 09.01.2020, with all consequential and other attendant benefits, in consideration of the representation submitted by the petitioners, within a time frame to be fixed by this Hon'ble Court.

2. Heard the learned counsel on either side and perused the materials available on record.

A perusal of the counter filed by the third respondent revealed that the Board as per the order passed by the Hon'ble Supreme Court of India, dated 05.03.2021 revised the selection list by removing 27 candidates who were already appointed and included 37 new candidates and the same was published in the official website of TRB on 09.04.2022. Accordingly, the selection list was sent to the User Departments.

4. In view of the above, the request made by the petitioners cannot be considered and the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. No costs. 10.07.2024 Internet: Yes Index : Yes/No Speaking/Non Speaking order mn
