An Award was passed by the 1st respondent - Labour Court, by which reinstatement of the 2nd respondent with back wages has been ordered. As against the said order, the present Writ Petition is filed by the Management. Seeking compliance of 17(b) of the Industrial Disputes Act and for payment of back wages, W.M.P.No.29083 of 2016 has been filed.

2. The issue is sought to be raised only by way of Writ Petition. The payment of 17 (b) wages is mandatory. The Writ Petitioner is directed to pay back wages to the petitioner under section 17(b) of the Industrial Disputes Act, on 15th day of every month commencing from 15th June, 2017. As the arrears payable under Section 17(b) towards back wages would come to higher amount, in order to balance the both sides, the petitioner/Management is directed to pay a sum of Rs.5,00,000/- in favour of the 2nd respondent/workman within 8 weeks from the date of receipt of copy of this order.

3. Accordingly, WMP.No.29083 of 2016 is ordered and the order of Interim Stay granted in WMP.No.24289 of 2016 is made absolute subject to the conditions stated above. The other petition in W.M.P.No.29082 of 2016 is closed.

Post the Writ Petition on 24.10.2017.
