ORDER
The petitioner apprehends arrest for the alleged offence under Sections 191(1), 296(b), 115(2), 118(1) and 351(2) of BNS Act, 2023, in Crime No.135 of 2026, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that, due to previous enmity arising out of an earlier incident at a biriyani shop, on 13.04.2026, the petitioner along with other accused attacked the defacto complainant and caused injuries using a beer bottle and a knife. Hence, the case.
3. The learned Counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has got 13 previous criminal antecedents. Hence, she opposed to grant anticipatory bail to the petitioner.
5. From the submissions made by the learned Government Advocate (Crl.side), it is amply clear that if the petitioner is enlarged on bail, there is every likelihood of committing similar offence, which would pose a menace to society. Therefore, considering the larger interest of the society, this Court is not inclined to enlarge the petitioner on anticipatory bail.
