A.Vadivel, Wireman working in M.E.S, Guindy, Tamil Nadu Electricity Board, died on 15.12.1987, leaving behind four daughters and two sons. Except the married elder daughter, namely Kanchana, the other five of his children were minors at the time of his death. His wife Annakilli predeceased him. P.Gajendran is the son-in-law of the deceased Vadivel, his wife, Tmt.Kanchana, the eldest daughter of Vadivel had taken care of the minor children.
2. P.Gajendran filed an application before this Court to appoint him as guardian for the minor children and same was allowed by this Court in O.P.No.404 of 1988. The GPF, Special Provident Fund, Family Benefit fund, Death-cum-retirement gratuity and leave encashment which stood in the name of Vadivel were allowed to be withdrawn by the petitioners. After crediting 1/6th of the amount to the major daughter, Kanchana, the remaining funds were ordered to be invested in the Reserve Bank of India. These petitioners were allowed to withdraw the accrued interest once in three months for the benefit of the minors.
Subsequently, two of the minors by name, Banumathi and Raghu on attainment of majority, the petitioner P.Gajendiran was discharged from guardianship in respect of those two minors, after declaring them as major. This order was passed pursuant to the application Nos.4447 to 4450 of 1999, dated 05.01.2000.
3. The present application Nos.4640 to 4643, 4645, 4646 of 2024 are filed for the following relief:- (i) A.No.4640 of 2024 is filed to declare the applicant as major. (ii) A.No.4641 of 2024 is filed to discharge the petitioner from the guardianship.
(iii) A.No.4642 of 2024 is filed to declare the applicant as major. (iv) A.No.4643 of 2024 is filed to discharge the petitioner from the guardianship.
(v) A.No.4645 of 2024 is filed to declare the applicant as major. (vi) A.No.4646 of 2024 is filed to discharge the petitioner from the guardianship.
4. The date of birth of Sakthivel S/o.Vadivel is 05.06.1979, the date of birth of Girija D/o.Vadivel is 02.08.1981, the date of birth of Shyamala D/o.Vadivel is 06.07.1983. Now, All three of them have attained majority. Therefore, on their attainment of majority, the petitioner is hereby discharged from the guardianship of these three minors, namely, Sakthivel, V.Girija and Shyamala and they are declared as major. Pursuant to this order, the minors who have now declared as major are entitled to deal with the money deposited in their accounts as per the order passed by this Court in O.P.No.404 of 1988, dated 07.10.1988.
5. Accordingly, these Application Nos.4640 to 4643, 4645, 4646 of 2024 are disposed of.
