Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the First and Second Respondents to take necessary action against the Third Respondent for issuing illegal Certificate to the Fourth Respondent and pay compensation to the tune of Rs.3,00,000/- to the Petitioner by considering his representation dated 17.06.2019.

O R D E R

The Writ Petition has been filed for a direction to the First and Second Respondent to dispose the representation dated 17.06.2019 made by the Petitioner to take action against the Third Respondent for having excluded the name of the Petitioner while making entries for transfer of name in the Possession Certificate of the property belonging to his father by granting https://hcservices.ecourts.gov.in/hcservices/

the same exclusively in favour of the Fourth Respondent and to pay compensation of a sum of Rs.3,00,000/- for the same. 2.

When it is pointed out that in the absence of any challenge to the exclusion of the name of the Petitioner in the Possession Certificate, it was not possible to direct the Respondents to take action against the Third Respondent for the same, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to work out his remedy for including his name in the Possession Certificate and seek consequential relief before the competent forum in the manner recognized by law after impleading all necessary parties and he has made an endorsement to that effect, which is recorded.

Accordingly the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
