Writ Petitions are filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents herein to return the driving license No.TN 7419930002968 to the petitioner.

O R D E R

The writ petition is filed to issue Mandamus directing the respondents to return the driving license to the petitioner.

2. The petitioner herein is a driver of passenger car bearing No.TN 07 BJ 6484. He has caused an accident on 17.06.2019, while driving his car causing death of one boy. The police has registered a criminal case against the petitioner in Crime No.134/2019, on the file of Pennadam Police Station. Consequently, the respondent has seized the driving license of the petitioner and initiated proceedings under Section 19 of the Motor Vehicle Act. The petitioner has given representation on 20.06.2019. Since no order has been passed in the enquiry proceedings, he has approached this Court by way of writ petition.

3. The learned Additional Government Pleader took notice for the respondents and submitted that the explanation given by the petitioner for the show cause notice is under consideration and the order will be passed in due course.

4. In the light of the above submissions, this writ petition is disposed of with a direction to the respondents to dispose the enquiry proceedings initiated by them under Section 19 of the Motor Vehicle Act within a period of two weeks from today. No costs.
