ORDER

This Criminal Miscellaneous Petition has been filed seeking modification of the condition imposed upon the petitioner in Paragraph 7(c) in Crl.OP.No. 8859 of 2026 dated 08.04.2026 that "the petitioner is directed to deposit a non-refundable sum of Rs.1,00,000/- (Rupees One lakh only) through Demand Draft in favour of the " The Head Master, Pudusampalli, Government Higher Secondary School, Pudusampalli, Mettur Taluk, Salem District" The Demand Draft shall be handed over to the Assistant Educational Officer, Salem District".

2. The learned counsel for the petitioner submitted that the petitioner has resigned his post as a counselor and he is having difficulty to mobilize the money and unable to comply the conditional order imposed by this Court. Hence, he prayed for modification of the said condition.

3. The learned Government Advocate (Crl.Side) reiterated the prosecution case and submitted that the Petitioner has unable to comply the conditional order of this Court. Hence, he opposed to allow this petition.

4. Heard both sides and perused the materials available on records.

5. Considering the nature of offence and the way in which behaved and the seriousness of the allegations, this Court does not find any reason to modify the condition.

6. Accordingly, this Criminal Miscellaneous Petition stands dismissed. 02-06-2026 Vv To
