ORDER

The petitioners have come forward with this petition under Section 482 of Code of Criminal Procedure, to call for the records in Crime No.1061 of 2015 on the file of the 1st respondent police and quash the same.

2.Today (18.03.2016), the first petitioner and the second respondent, their respective counsel and the learned Additional Public Prosecutor were present and their identification is also https://hcservices.ecourts.gov.in/hcservices/

verified by this Court. The second respondent filed an affidavit stating that even though the case has been registered against the 1st petitioner for the offences punishable under Sections 493, and 506(i) of I.P.C. and Section 3(1) (x) and (xi) of Schedule Caste and Schedule Tribes (Prevention of Atrocities) Act 1989, since the matter has been compromised before the Mediation, has no objection for quashing the proceedings in Crime No.1061 of 2015 on the file of the 1st respondent police. It is further submitted that a petition has been filed under Section 13(B) of Hindu Marriage Act, 1955 in H.M.O.P.No.4697 of 2016 before the II Additional Family Court, Chennai for divorce. 3.Considering the nature of allegation and also considering the affidavit filed by the second respondent, this Court is of the opinion that no useful purpose would be served by allowing the case to proceed with. Therefore, the entire proceedings in Cr.No.1061 of 2015 on the file of the 1st respondent is hereby, quashed and this Criminal Original Petition is allowed accordingly.
