Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the proceedings in No.1011/Muu1/2025 dated 23.12.2025 by the second respondent and quash the same and consequently direct the second respondent to grant 28 days ordinary leave without escort to petitioner's husband David Inbaraj, S/o.Rathinam, CT No.5773/ PID No.485763, is

) Heard both sides.
2. The writ petitioner's husband was convicted for an offence under POCSO Act, 2012 and he is undergoing ten years rigorous imprisonment in Central Prison I, Puzhal, Chennai. The judgement was rendered on 19.11.2014. The prisoner went on 21 days' ordinary leave without escort pursuant to the orders of this Court dated 25.04.2025 in W.P.No.10246 of 2025 from 02.05.2025 to 22.05.2025. Even before the expiry of one year period, a fresh application for grant of 21 days' ordinary leave was submitted. On this ground, the prisoner's request was rejected.
3. We do not find any ground to interfere. Since one year period has since expired, it is open to the petitioner to submit a fresh application. The learned Additional Public Prosecutor informs this Court that the fresh
application, if any, filed will be considered on merits and in accordance with law.
4. The Writ Petition stands disposed of accordingly, with the aforesaid liberty. Consequently, connected miscellaneous petition is closed. [G.R.S.,J.] [V.L.N.,J.] 20.05.2026 Index : Yes/No ms/mk To 1.
