W.M.P.No.22025 of 2019 in W.P.No.1209 of 2019 PUSHPA SATHYANARAYANA, J.

This petition is filed by the petitioner/5th respondent seeking to recall the order dated 22.01.2019 made in W.P.No.1209 of 2019.

2. Earlier, by order dated 22.01.2019 made in W.P.No.1209 of 2019, this Court directed the District Revenue Officer, Salem District, Salem, to consider the representation of the petitioner dated 03.10.2018 and dispose of the same within a period of four weeks from the date of receipt of a copy of that order, after issuing notice to the writ petitioner, respondents 4 to 9 therein, as well as other interested parties and affording them an opportunity of personal hearing before passing the order.

3. The fifth respondent in the said Writ Petition has filed the present petition to re-call the said order dated 22.01.2019 stating that it is an innocuous order. It is also stated that certain facts were suppressed.

The said Writ Petition was filed only for a mandamus and this Court had not gone into the merits of the case and only issued a direction to the second respondent to dispose of the representation. Hence, such orders cannot be re-called.

In view of the above, this application is dismissed. If the petitioner is so aggrieved by the said order, it is open to him to take appropriate proceedings or appear before the authorities for an enquiry.
