Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to the respondents to grant 2 days emergency leave without escort to the brother of the petitioner namely Sriram S/o Manokaran by considering petitioner's representation dated 15.05.2026.

(Order of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides.

2. The writ petitioner's brother is an under-trial prisoner. He is ranked as A4 in Spl.C.C.No.220 of 2024 on the file of the learned Sessions Judge, Mayiladuthurai. He was arrested and remanded to judicial custody on 22.03.2026. It is a case involving offences under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. Learned counsel for the petitioner states that he is unable to move the trial Court for relief. The petitioner's father had passed away on 07.05.2026 and the 16th day ceremony falls on 22.05.2026.

4. We cannot grant bail without hearing the defacto complainant However, limited relief is granted to the under-trial prisoner by directing the Superintendent, Central Prison, Salem to take the petitioner's brother Sriram, S/o.Manokaran with due escort to the petitioner's residence at Mayiladuthurai on 22.05.2026. The escort vehicle will leave the prison premises at 5.00 a.m. on 22.05.2026. After the ceremony is performed, the under-trial prisoner will be brought back to the Central Prison, Salem on the very same day. The cost of providing escort and the transport arrangement will be borne by the writ petitioner. He undertakes to remit the cost in advance upon being intimated about the same.
