The applicant/plaintiff filed a suit against the respondents, seeking declaration that the unilateral cancellation of the Negotiated Settlement dated 29.12.202, by the first and second respondents is illegal, void ab initio and non-est. The plaintiff also seeks declaration that the Negotiated Settlement dated 29.12.2021, is valid and binding on the first and second respondents. The applicant also seeks a mandatory injunction directing the first and second respondents to release the documents of title relating to Suit schedule property.
2. In the affidavit filed in support of this application, it is stated by the applicant that the cause of action for the suit arose in Chennai. All transaction pertains to the suit had taken place within the territorial limits of Chennai in the Branch office of the second respondent/defendant. It is also asserted that the borrowings, mortgage of the suit property and the repayments etc., had taken place in the Branch office of second respondent within the territorial limits of this Court.

3. In view of the assertions made in the affidavit filed in support this application, leave is granted. The application in A.No.3247 of 2023 is allowed.
