The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 85 and 115(2) of BNS Act in Crime No. Not known of 2025, seeks anticipatory bail. 1/4

2. The case of the prosecution is that the due to the matrimonial dispute, the defacto complainant left the matrimonial home and lodged a complaint in Cr.No.22 of 2025 against the petitioners. Hence, the complaint.

3. Learned counsel appearing for the petitioners submitted that the Crime Number was already registered as Cr.No.22 of 2025. He further submitter that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that they are in no way connected with the alleged offence. He further submitted that the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and submitted that the Crime Number was registered as Cr.No.22 of 2025, but this petition is filed as Cr.No.Not known of 2025 and he opposed for grant of anticipatory bail to the petitioners.

5. Heard both sides and perused the materials available on record.

6. Considering the above facts and circumstances of the case and submissions made on either side and since this petition has been filed as crime number not known, whereas the FIR has been registered as Cr.No.22 of 2025, this court is not inclined to grant anticipatory bail to the petitioners. 2/4

7. Accordingly this petition is dismissed. However, the petitioner is at liberty to file a fresh petition by quoting the crime number. 23.06.2025 gv
