ORDER
This Criminal Original Petition has been filed seeking a direction to the learned Principal District and Sessions Judge, Special Court for Trial of cases under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Chengalpattu, to accept the surrender of the petitioners and consequently, consider their bail petitions on the same day, on merits, in connection with Crime No.194 of 2026 on the file of the second respondentpolice. 2.
The case of the prosecution is that on 23.04.2026, at about 02.30 a.m., the petitioners, along with other accused, abused the de facto complainant by making caste-related remarks and threatened them with dire consequences. Based on these allegations, an FIR has been registered against the petitioners and other accused for the offences punishable under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(3) of BNS, 2023 and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby directs the learned Principal District and Sessions Judge, Special Court for Trial of cases under Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, Chengalpattu, to issue prior notice to the de facto complainant and thereafter, to consider the bail applications of the petitioners on the same day of their surrender before that Court in connection with Crime No.194 of 2026 on the file of the second respondent police, after affording due opportunity to the victim. The petitiones shall surrender before the Special Court for Trial of cases under Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, Chengalpattu, within a period of 15 days from the date of receipt of a copy of this order.
