This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 12.06.2024, seeking bail in Crime No.313 of 2024 registered for the offence under Sections 341, 294(b), 323, 397, 336 & 506(ii) of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case since he has several previous cases. He further submitted that the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 12.06.2024. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that, the petitioner/A2 along with A1 waylaid the de facto complainant, abused him in filthy language, robbed a sum of Rs.620/- from him at knife point, threatened him with dire consequences and escaped from the spot. He further submitted that the case is under investigation and the petitioner, who is a habitual offender, having 13 previous cases including the cases registered for the offence under Section 302 IPC. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that the investigation is not yet completed and also considering the antecedents of the petitioner/A2, this Court is not inclined to grant bail to the petitioner.
