The petitioner, apprehends arrest for the alleged offences under Section 4(1)(A) & 4(1) (i) of the Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.83 of 2025, on the file of the respondent police, seeks anticipatory bail. 1/4

2. The case of the prosecution is that while the respondent police were at regular patrol work, the petitioner along with A2 were found in illegal possession of 94 Top Star Brandy bottles and the entire contraband and cash of Rs.400/- were seized by the respondent police. Hence, the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Further, the learned counsel submitted that the petitioner has been falsely implicated in this case only for statistical purpose. However, on instructions, the learned counsel further submits that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court and hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that there is no previous case pending against the petitioner. However, he opposed for grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
