PRAYER : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, directing the respondent police not to harass the petitioner in any manner whatsoever, based on the complaint given by the respondent Nos.3 & 4 dated 19.08.2021.

This Criminal Original Petition is filed to direct the respondent police not to harass the petitioner in any manner whatsoever, based on the complaint given by the respondent Nos.3 & 4 dated 19.08.2021.

2.The learned counsel appearing for the petitioner submits that the petitioner is a real estate broker and he had received a sum of Rs.10,00,000/- from Chinnaiyan, the third respondent herein. Thereafter for some reason, the sale deed could not be executed. The petitioner admits that he had received the above said amount and now he is willing to settle the issue. The only thing is, he seeks some more time to settle the issue. Further he submits that he is compelled to give an undertaking that he would repay the amount.

3.On perusal of the complaint and on the materials found, it is seen that there seems to be some materials against the petitioner. In view of the same, the respondent police is directed to proceed with the complaint, if cognizable offence is made out.

4.With the above direction, this Criminal Original Petition stands disposed of.
