This petition is filed by the petitioner / appellant / claimant seeking exemption of payment of court fee for a sum of Rs.12,975/- in the above Appeal.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner / claimant / injured was awarded with a sum of Rs.1,29,841/- with interest at 7.5% per annum, as total compensation, as against the claimed amount of Rs.25,00,000/-. He further submitted that due to the injuries sustained by the petitioner on account of the accident, the petitioner was under mental agony and stress and hence, he could not able to go for any work and mobilize funds to pay the court fee. He also submitted that the petitioner undertakes to pay the court fee in the event of succeeding in the Appeal.

The learned counsel for the petitioner would also submit that the entire award amount, as ordered by the Tribunal, had already been deposited by the second respondent / Insurance Company and the same was withdrawn by the claimant / petitioner. In such circumstances, this Court is not inclined to accept this petition seeking exemption of paying court fee and the same is accordingly, dismissed. However, eight weeks time is granted from today to pay the necessary court fee by the petitioner.
