Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to disburse the petitioner's leave encashment benefits which he is entitled for the periods of 11/2018 and 11/2019 with interest at the rate of 8% per annum from the said date of entitlement to till the date of actual disbursement.

ORDER

This Writ Petition has been filed for a direction directing the respondents to pay the petitioner for the amount payable towards the encashment of earned leave surrendered by the petitioner with interest at the rate of 8% per annum.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner was working as Special Grade Driver in the respondents Corporation and he retired from service on 30.06.2022. While settling his terminal benefits, the respondent failed to pay and settle the amount payable towards earned leave, which were surrendered by the petitioner before his retirement. It is also admitted by the respondents in the information dated 13.12.2023 given under RTI Act that the petitioner is entitled for the same.

4. Considering the above facts and circumstances of the case, the respondents are directed to pay the amount payable towards

encashment of earned leave, which were surrendered by the petitioner, with applicable interest within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
