The petitioner is the accused in S.C.No.301 of 2023 for the offence under Sections 302, 120B, 341, 384, 364A, 506(2), 342, 201, 109, 212 of IPC seeks quash of the case on the ground that there is no incriminating material against this petitioner except the confession statement of the coaccused and the petitioner's name was included in the course of investigation by way of alteration report just to wreck vengeance. 2.
The learned Government Advocate (Crl.Side) appearing for the respondent police states that it is a case of abduction and murder for ransom and this petitioner is an History Sheeter who along with other accused has involved in the crime which has come to notice of the Investigating Officer in the course of investigation. Apart from the confession statement of the co-accused implicating this petitioner, the other circumstantial evidence also indicates that this petitioner previewed to the crime and one of the conspirator implicated this petitioner. He further states that there is a direct eye witness to show the involvement of this petitioner in the incident which occurred on 22.05.2017, the date on which the victim was beaten by the accused persons including the petitioner herein in the public. 2/4

This Court, after perusing the statement of witnesses, including the confession statement of the co-accused implicating this petitioner, finds that the grounds raised by the petitioner herein to quash the petition is unsustainable and contrary to the material on record. Hence this Criminal Original Petition is dismissed.
