ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 25(1)(a) of Arms Act and Section 4(1)(a), 4 (1-A) of TNP Act in Crime No.29 of 2026, seek anticipatory bail.

2. The case of the prosecution is that on 30.01.2026 at about 07.00 hours, when the defacto complainant and his police party were in regular patrol near Aladipatty Coconut field, the co-accused /A1 is said to have found in possession of 25 litres of I.D Arrack containing ingredients of poisonous substances. During enquiry, the respondent police recovered three SBML country made guns from the accused/A1 to A3. Hence, the present case.

3. The learned counsel for the Petitioner submits that the petitioner is not at all involved in prohibition offence, however, a false case has been foisted against him as if he was in possession of country made gun. Hence, he prays to grant anticipatory bail to the petitioners.

4. However, the said contention was totally objected by the learned Government Advocate (Crl.Side) and submits that from the first accused,

country made arrack was recovered and these Petitioners are closely associated with the first accused and from them three country made guns were recovered, which is serious in nature. He further contended that if the petitioners are enlarged on bail, they will not have a fear upon the law and they would embolden to do the manufacturing of country made arrack which contentions of the learned Government Advocate (Crl.Side) cannot be slightly brushed aside.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. Considering the nature of offence and serious allegations against these petitioners, this Court is of the firm view that the petitioners does not deserve anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 02-06-2026 Vv
