J U D G M E N T

Both counsel present and heard. It is represented that the appellant Kaliyaperumal.M had died on 06.12.2008 and the same also is fortified by the copy of the death certificate filed in this matter. It is further represented by both the parties that the quarters which is the subject matter of the dispute is also vacated and the same had been put in evidence from the letter addressed by the NLC India Limited to the Secretary, Thrift & Credit Society Limited, Block-12, Neyveli-3 and hence it is seen, the Second Appeal has become infructuous.

2. In the light of the above position, the Second Appeal is dismissed as infructuous. No costs.
